dc.description.abstractBu çalışma, Karayipler Topluluğu (Caribbean Community-CARICOM) bünyesindeki kişilerin serbest dolaşımına ilişkin rejimi ve bu uluslararası örgütün kurumlarından biri olan Karayipler Adalet Divanının (Caribbean Court of Justice-CCJ) bu rejimin gelişimine yönelik katkısını incelemeyi hedeflemektedir. Kişilerin serbest dolaşımı, bölgesel bütünleşmeyi amaçlayan CARICOM içerisinde ele alınan politika alanlarından biridir ve bu politika alanı kapsamında kişilere birtakım haklar getiren bölgesel bir yasal rejim oluşturulmuştur. Kişilerin serbest dolaşımı rejiminin bölgesel düzeyde yeknesak bir şekilde uygulanması hem CARICOM kurucu antlaşmasında belirlenen hedeflerin gerçekleşmesi hem ilgili rejimin etkinliğinin sağlanması hem de bu rejim dâhilinde kişilere temin edilen hakların güvenceye alınması açısından gerekli olmaktadır. Bu durum, CARICOM kurucu antlaşması normlarının yorumlanması ve uygulanması nedeniyle meydana gelebilecek uyuşmazlıkların çözümüyle yetkilendirilen ve gerçek ve tüzel kişilerin başvurabileceği bir uluslararası yargı organı olan CCJ’nin önüne gelen davalarda tesis ettiği kararların, kişilerin serbest dolaşımına ilişkin bölgesel rejimin gelişimi ve etkinliği açısından dikkate alınmasını gerektirmektedir.
dc.description.abstractThis study aims to examine the regime regarding the free movement of persons within the Caribbean Community (CARICOM) and the contribution of the Caribbean Court of Justice (CCJ), which is one of the institutions of this international organization, to the development of this regime. Free movement of persons is among the policy areas addressed by the CARICOM that attempts to achieve regional integration, and a regional legal regime that ensures specific rights to persons has been forged in this policy area. The uniform implementation of the regime of free movement of persons at the regional level is essential to reach the objectives set out in the CARICOM founding treaty, ensure the effectiveness of this regime, and safeguard the rights granted to individuals with the stated regime. Thus, it is required to consider the decisions of the CCJ, which is an international judicial body to which natural and legal persons may appeal and which is authorized to resolve disputes that may arise due to the interpretation and application of the norms of the CARICOM founding treaty, for the development and effectiveness of the regional regime on the free movement of persons.
